The Directorate General of Trade Remedies (DGTR) has rescheduled the oral hearing in the ongoing sunset review investigation of anti-dumping duties on imports of methyl acetoacetate (MAA) originating from China.

MAA is a key chemical intermediate extensively used in the pharmaceutical sector for synthesizing various drugs and intermediates.

According to the DGTR, the oral hearing will now be held at 3:00 pm (IST) on October 8, 2025. The proceedings will take place in the Conference Hall of DGTR in New Delhi, offering both in-person and virtual attendance options. Interested parties are invited to participate via digital video conferencing (DVC), ensuring wider accessibility for stakeholders both within India and abroad.

This hearing marks a pivotal moment in the investigation, which assesses whether the continued imposition of anti-dumping duties is necessary to offset potential injury to domestic producers from unfair trade practices.

While the timing of the hearing has changed, all other procedural details remain unchanged. The DGTR has reiterated its commitment to transparency and due process in its trade remedy actions, urging all stakeholders to remain engaged.

The outcome of this sunset review holds significant implications for India’s pharma industry, particularly manufacturers dependent on fair trade conditions in the market for MAA, a critical intermediate used in pharmaceuticals.

The DGTR had initiated sunset review investigation in July 2025 concerning the anti-dumping duty on MAA imported from China following an application submitted by Laxmi Organic Industries Limited, a domestic producer. The company had requested a review to ensure continued protection against unfair trade practices.

The review is being conducted under the provisions of the Customs Tariff Act, 1975, and the associated Anti-Dumping Rules, 1995. According to Section 9A(5) of the Act, any anti-dumping duty imposed is set to expire after five years unless a sunset review determines that such expiry would likely lead to the recurrence of dumping and injury to the domestic industry.

The original investigation into dumping of MAA from China and the USA was initiated in January 2015, culminating in a recommendation for anti-dumping duty in April 2016. The ministry of finance imposed definitive duties through a Notification on May 31, 2016.

The first sunset review was initiated on May 03, 2021. It concluded that dumping from China was ongoing and that ending the duties would result in further injury to the domestic industry. Consequently, the anti-dumping duty was extended for another five years through a Notification dated May 29 2021, effective until May 28, 2026.

The present sunset review was prompted by the imminent expiry of the current anti-dumping duty. Laxmi Organic Industries Limited has asserted that dumping continues, with no significant market changes since the previous review. The company officials emphasize that the continued imposition of anti-dumping duties is essential to prevent injury to the domestic industry.

The DGTR, therefore, decided to initiate the sunset review investigation to determine whether the withdrawal of the current anti-dumping duties would likely lead to the recurrence of dumping and subsequent harm to domestic producers.
